Pür Shilajit Wholesale Terms and Conditions
Welcome to Pür Shilajit! We appreciate your interest in our wholesale offerings. To ensure a clear and mutually beneficial agreement, please review the following terms and conditions, which govern all wholesale transactions.
1. Order Acceptance
All wholesale orders are subject to acceptance by Pür Shilajit. Pür Shilajit reserves the right to accept or decline any order for any reason.
2. Non-Refundable Policy on Delayed Shipments
Due to the nature of wholesale purchases, all sales are final and non-refundable. Any shipment delays arising from causes outside Pür Shilajit’s control do not qualify for refunds, credits, or returns.
3. Force Majeure
Pür Shilajit is not liable for any delay in delivery or inability to perform due to causes beyond our control, including but not limited to natural disasters, acts of government, labor strikes, supply chain interruptions, or other force majeure events. Pür Shilajit will make reasonable efforts to notify buyers of such delays.
4. Shipping and Handling
Pür Shilajit will arrange shipping using standard carriers. Shipping costs are borne by the buyer, and delivery times provided are estimates only. Pür Shilajit is not responsible for delays once the shipment is in transit or for customs-related delays on international orders.
5. Inspection and Acceptance of Goods
Buyer is responsible for inspecting the order upon receipt and must report any defects within 48 hours. Failure to notify within this period constitutes acceptance of goods as-is.
6. Intellectual Property
Pür Shilajit retains all rights to logos, product names, and branding associated with its products. Buyer agrees not to alter, rebrand, or misrepresent Pür Shilajit products without prior written permission.
7. Indemnification
Buyer agrees to indemnify and hold Pür Shilajit harmless from any claims, damages, or losses resulting from buyer’s handling, usage, resale, or misrepresentation of Pür Shilajit products.
8. Custom Branding and Labeling (If Applicable)
For customers interested in custom branding or labeling, additional terms and conditions will apply, including customization fees and intellectual property rights related to brand usage. Please contact Pür Shilajit for specific custom branding guidelines.
9. Disclaimer of Warranties
Pür Shilajit disclaims any warranties, express or implied, regarding specific health outcomes or benefits of our products. Buyer understands and agrees that use of Pür Shilajit products is solely at the buyer's discretion.
10. Confidentiality
Buyer agrees to keep all pricing, terms, and conditions of this agreement confidential, disclosing them only to personnel who need access to this information to fulfill buyer obligations.
11. Product Recall or Return Policy
In the event of a product recall or quality issue due to factors solely attributable to Pür Shilajit, we will notify all affected buyers promptly. Returns for product recalls must be pre-authorized, and Pür Shilajit will not accept returns on goods that have been opened, used, or altered.
12. Governing Law and Jurisdiction
This agreement shall be governed by the laws of [New Mexico, U.S.]. Any disputes arising under this agreement shall be resolved exclusively in the courts of Clearwater, Florida.
13. Right to Amend Terms
Pür Shilajit reserves the right to modify these terms and conditions at any time. Updates will be provided to existing wholesale customers, and continued business with Pür Shilajit constitutes acceptance of the revised terms.
